    It's not true.

Years ago it might have been true (I have read such accounts), but not anymore. The child needs a medical exam and a visa. The Green Card is not issued until after the $165 fee is paid online to USCIS, and the Green Card then shows up 30-45 days after the child arrives in the U.S.

My wife is pregnant now. She wants to give her baby's birth in her back home country.

I read on some immigration lawyer's website that a Permanent resident can give birth out side the US and they can bring his/her child to US in their first return to U.S and child should not be older than 2 years of age. In that way new born child doesn't need visa to come to U.S and the child can get his /her green card on arrival airport in U.S.

    Please reply me.

I haven't found it on the USCIS website. Please let me know is that true?

      Live Out side from USA

      Hi
My wife is a Green card holder. She wants to come to her back home country for 4 to 5 months next month in April. She arrived in U.S on 28 February 2015. My question is that if she stays outside from USA for more than 4 months or 5 months but less than 6 months so will she be able to come back to USA without any problem. Her green card holder will be on risk if she stays out side USA for 5 months or less than 6 months.
      Regards

        Brit Guy,

A Green Card holder can stay outside the U.S. for up to a year without risk to her Green Card status, and up to two years if she has a Reentry Permit.

But if she stays out six months or longer, her "continuous residency" eligibility criteria for eventual U.S. Naturalization will be affected.

          Green Card

          Hi Ray B.

          Thank you for your help.

My wife green card is not arrived yet at her address. She landed in Dallas on 28 February 2015.

She wants to come back to her back home country for 3 to 4 months. She has stamp on her passport that will be expired on 17 June 2015.

She got this stamp on 30 December 2014. USCIS gave a very short expiry date just for 6 months.

She doesn't pay any fee for green card after the payment of $320 at time when she got her visa stamp from her back home country's embassy.

Please let men know what should she does?
          Kind Regards

The Green Card should show up in 30-40 days.

                  Green Card Payment

                  Hi Ray B

I just paid my Wife's immigration fee of $165 (plastic green card fee).

I read in ELIS that returning residents SB1 visa holders are exempted from this immigration fee £165.

Can u please confirm me about this matter and what should i do now.

                  Regards

                    spouse petition

                    Hi Ray B.

Sorry to disturb you again and again.

My wife is a green card holder . She landed in USA on 28 February 2015. She has sent my petition through USPS to USCIS office Arizona. My wife already submitted our marriage certificate in U.S. Embassy when she got her returning resident SB1 Visa from back home country. When my wife decided to go to USA as she is a green card holder so i applied for visit visa for attending the conference there.I applied for visit visa from my country. But US consulate of my country rejected my visit visa and told me that they can't allow me to go U.S. for attending the conference and i have a chance to apply for visit visa in future again but this time i was not eligible .My wife filed my spouse petition from USA. So i just want to confirm that rejected visit visa does impact on my spouse petition.

                    Kind Regards

Normally, a prior rejection of a nonimmigrant visa (visitor, studeent, etc.), if based on routine rejection criteria, is "without prejudice" and won't adversely affect a future immigrant visa application.

                        Plastic Green Card

                        Hi
My wife has entered in U.S on 28 Feb. 2015 as returning resident SB1. USCIS issued her a new A- number. She submitted her green card fee online through ELIS $165. But i read in ELIS that applicants returning resident SB1 are not required to pay the immigration fee $165. But i paid it by my debit card. Please confirm me about the refund if i am eligible for this amount of $165.
I need to know about my new plastic green card. Does USCIS will send me the new green card automatically or should i need to fill the form I-90. When will it to be delivered to my address as i updated my address online and at the time of my arrival on airport.

                        Kind Regards

I can't answer your question about a refund for payment made for a Green Card for your wife. If you were allowed to pay the $165 for your wife's SB1 Green Card, I doubt that you'll be able to get that $165 back.

I don't understand your second question about your (?) new Green Card. Or was that about your wife's Green Card?

There is no reason to have to submit an I-90 for her card, as payment of the $165 card fee and submittal of an I-90 would be redundant.

The only way you can track the card status is to go back to the ELIAS account you set up and see if there is any information resulting from your fee payment.
