  • Immigrant Family Visa - Affidavit of Support by Sponsoring Family via Personal Assets

    My sponsor makes little income and I have no family / friends in the USA to act as a co-sponsor. I read I can submit an Affidavit of Support regarding my personal assets to make up for the shortfall in income required for sponsors. (posted question and website I saw this mentioned in below) I have a family of 4 (2 kids, wife, myself) and my assets total to about $800,000 (including assets such as house, cars, income, etc). This is well above the income requirement. However, given the size of the family (4 people), would this be okay? Is there any law/regulation which allows this?

    I have no income and cannot find a co-sponsor, what else can I do to sponsor my wife?

    You may provide evidence of assets that are readily available and, combining with your total household income, fulfill the income eligibility requirement. Your wife’s income may also be included as your household income if she has been living with you for the last 6 months. [8 C.F.R. 213a.2 (c)(1)]

    For example: Mr. Chang is unemployed and has no income, but he has a house with a current value of $500,000 free from any liabilities. He may submit evidence of his ownership of the house to meet the financial support requirements.

    It's not quite that simple. Are your assets outside the U.S.? Can you provide proof of being able to convert your assets to three times the income deficit for your family size?

      Hi Ray,

      Yes - all assets are Canadian. Taking the house for example, by checking at the current market prices for similar sized houses in our area, it is already at $750,000. Even at the purchase price at about 15 years ago, it would be about $400,000CDN. Note this excludes all other assets.

      What would be the income requirement for a family of four? All I can find is the income requirement for a sponsor's family (family of four is about $30,000). As well, would our request be rejected based on family size? Since the below example only referred to a couple. If rejected, and we cannot find another sponsor, is there anything else we can do?

        The annualized income requirement for four people (including the immigrant) is a tad less than $30,000.

        It is difficult to substitute real estate equity for an income deficit, as it is hard to prove that cash could be pulled out of equity on short notice, much less if the property is outside the U.S.

        The petitioner must be the primary sponsor, whether he has proof of sufficient income or not. A co-sponsor (which you posted earlier is not available to you) can be a joint sponsor, but his income must cover his own famliy and your wife.
