  • How to fill form I-864 (need help)

    Please advice me on the following:

    - in Form I-864 Part 3. I am sponsoring my wife so I marked as (YES). Am I suppose to count my two kids as a family members, knowing that they are a US citizens?
    If I don't count them then number 7. Enter the total number of immigrants you are sponsoring will be 1.

    - in Form I-864 Part 5. to calculate the Household size:
    1. Enter the number you entered in line 7 of part 3. (1)
    2. yourself. (1)
    3. If you are currently married enter 1 for your spouse. (1)
    4. If you are having dependent children enter the number here (2)

    8. Add together lines 1-7 and enter the number here. household size (5)

    My actual household size is (4). How can I correct the mistake?

    COUNT YOUR KIDS, BUT YOUR SPONSORED IMMIGRANT WILL BE '1', AND YOUR HOUSEHOLD SIZE WILL BE '4.'

    DON'T COUNT SPOUSE IF SHE IS THE IMMIGRANT.

      Thank you for your reply. I still need your clarification once more to understand how to count my kids When filling Form I-864.

      I am currently employed overseas and my two kids are a U.S Citizens.

      Should I count my kids in Part 3 as a "family members" or in Part 5 as "having dependent children"

      In case I count my two kids in Part 3, the total number of immigrants I am sponsoring will be "3" or "1" ?

      Should I mention them again in Part 5 as having dependent children?

        Your two children would not be considered immigrants (if they are already U.S. citizens). They should be counted in Part 5, #4.

          How to fill form I-864

          Many thanks for your prompt response. I highly appreciated your clarifications.

          In the meantime, Please advice me on the following:

          - In form I-864 Part 4 giving the fact that I am employed overseas:
          *Sponsor's Mailing Address: I have mentioned my house/property address in USA.
          *Sponsor's Place of Residence: should I mention the USA address or the address where I stay overseas.

          - In application DS-260 What to answer Do you have documentation to establish that you have received vaccinations in accordance with U.S. law? My spouse has no records. Please advice.

            The DS-260 vaccination question should be answered by: "visa-required medical exam and vaccinations have not yet been completed."

            Your I-864 is best left with your U.S. domicile address, as NVC mail can be delivered faster and with greater reliability, so long as you have arrangements for someone in the U.S. to monitor your mail.
