My fiance overstayed her tourist visa with her parents when she entered the US in 2001 when she was 14. She left the US in 2009 after completing her schooling.
From my understanding those who overstay their visa under the age of 18 are excluded from the 3 and 10 year ban. Technically her tourist visa expired when she was 14 but she stayed until she was 22 to complete her studies. Is she still subject to the 10 year ban because she left the country over the age of 18?
We are now getting married outside of the US (in Korea). I was hoping to return to the US after our marriage but it seems that might prove to be difficult.
Is our only option to submit the extreme hardship waiver? Any other options?
