Married my wife 9 years ago in the US. She is from a visa waiver country.
We own a home and have a 7 year old son, born in the USA.
I filed an I-130 Petition, and they set the interview for a 3rd country in the Middle east. I was working and living there with her when I filed the I 130 but moved back to the US since then.
We put out St. Louis address all over the documents.
I tried to call the consulate, email them, fax them to notify them, or at least change the date. They never responded.
The interview date had passed. My wife is still in the US.
I think I should have filed the I-485 with the I 130. Should I start over, and file a new I-130 with an I 485? Is there any way to get the BCIS to transfer the already filed, completely (and filing fees paid) I 130, or do we have to start over?
Is there any peril in the fact that we missed the I 130 interview?
Sorry I know this situation is a mess, but maybe someone knows the answer. We didn't want to travel to the consular interview, because they could have denied it and my wife would be stuck outside the US.
