  • Urgent-B1 to H1B- Problem in Chennai CP interview

    Hi folks:

    I entered US in a B1 visa an while in the US I got H1B1 (both processed by the same employer). I went for the CP interview in Chennai an the consular officer said that "you have changed your intentions after entering the US and its NOT GOOD!". However he said that my pasport is damaged (!!!) and I need to come back with a new one.

    Please let me know whether the move from B1 to H1B is not acceptable and can they Deny the IV for me. My wife came to US on a H4 and then later got a H1B.

    Urgent advice/info needed from all CP gurus.

    The consular officer is wrong.
    First of, it is perfectly ok to change intentions while in the US.
    Second, that's actually irrelevant since you left the US.

    And what "IV" are you talking about? IV is the usual abbreviation for "Immigrant Visa", and an H1 is a non-immigrant visa.
    Of course they can deny an H1. That is in the discretion of the consular officer.

      Thanks for the response. Actually I appeared for the Immigrant Visa interview and the Consular officer after going through my documents (prior H1B1 & B1) made the said comment. So is it possible or him to deny my GC based on the switch from B1 to H1B?
