  • Choosing CP after having put i-485 as option on 140 form?

I have a question about changing the option of going for consular processing since I had initially indicated the option of i-485 on the 140 form. Although I hav not applied for the concurrent i-485 filing.

Is there a form that I need to file in, since someone had mentioned that it takes upto 10 months to change the option from the 140 form that I had selected then.

Have you heard of anything about such a case?

Also replying to an above question, Attorney certified CP packet can be created and used to be accepted by Consulate at Bombay. I am not sure if that is still accepted. Any clues on what does a lawyer typically charge for making the ACCP packet.

    Thanks

"since someone had mentioned that it takes upto 10 months to change the option from the 140 form that I had selected then"

What that person probably meant is that an I-824 takes that long.
However, if you haven't filed a concurrent I-485, it should be much easier and there shouldn't be any need for an I-824.

    From http://travel.state.gov/visa/immigra...ypes_1309.html
"When you complete a petition (I-130, I-140, etc.) for an immigrant visa you send it to Citizenship and Immigration Services in the Department of Homeland Security for approval. If the CIS approves the petition they will send you a Notice of Approval (I-797) and then they will send the petition to NVC.
    [...]
If you live in the U.S., you may be eligible for adjustment of status as a permanent resident. When your case becomes current, NVC will send you a letter telling you that you may be eligible for adjustment of status and asking that you tell us if you will adjust or apply at a U.S. consular section abroad. If you write back to us that you will adjust status, we will note it on your case record and retain the file until an CIS office requests it to process your adjustment application. If NVC does not get a reply to our letter after 30 days, we will begin processing your case as if you have chosen to process at a consular office abroad."
