  • Can I still qualify for the DCF Procedure ?

    I married my wife in 2014 June, and we lived together from June 2014 to February 2015. Then I moved back to the States for personal reasons. And I want to know if I can still qualify for the DCF process since I am returning to live with my wife in Philippines in June 2016 until her Visa is approved then we will move to the States together.

    If you get a 13A residence status after you return to the Philippines, the Embassy "might" accept your DCF application. On the other hand, if you submit the spousal petition now, then go there while the petition is being processed, there is no uncertainty about having the Embassy accept your petition, and processing time will be about 10+ months.
