    My brother is in India presently and working with his USA employer in India.

    My brother could not attend multiple CP interviews in anticipation to get married. Finally he has got the call from Mumbai consulate to come for the intervew. They mentioned he should not miss this interview.

    What happens if he misses his last chance of interview? Is his application cancelled? His H1 is valid so could he go back to USA and apply for I-485? or his total GC application is cancelled.

    Need advice or suggestions.

    Gee, why didn't he call the consulate and asked for a rescheduling of the interview, instead of just not showing up?
    It could well be that the whole application gets canceled if he fails to show up repeatedly.

      He did call them all the time and got it postponed. But now consulate called back and told him that this interview is the last call. They did not mention what will happen if he does not attend.
      So I am trying to find out, what could happen? Will they cancel the application?

        Delaying the interview multiple times makes it look as if the job offer doesn't really exist anymore. I'd assume that's what the consulate thinks, so they may decide to deny the IV based on that.
        They could also just send the whole file back to BCIS. In this case, to activate it again, an I-824 would be required.
        In my view, a better way would be to attend the interview now. The IV is valid for 6 months, and if he marries before entering the US with the IV, his spouse could still get an IV as a follow-to-join case, which takes just a couple of months. Sure beats the 5+ years of sponsoring her once he is a PR.

          I am in the exact same situation right now.

          I got my first interview invite for December 2003, got it postponed and got a date for Jan 29th, got it postponed again to March 3rd and now would like to postpone one last time to say September 2004. The reason being that I anticipate getting married in September and would like to appear for the interview with my spouse.

          1. I would like to learn from your experience. What happened with your brother finally?

          2. Do you know if I can even ask for such a big delay in the date or is giving new dates completely random?
