  • Immigrant Visa - Precarious Situation!!!!

    Hello,


    My sister is a Registered Nurse passed CGFNS and got her Visa Screen Certificate. She applied for Immigrant Visa last April 2003 and got a Immigrant visa valid to October 2003.

    She is pregnant now and on hearing this her employer has asked her to join job after her delivery ie Jan 2004(by which time her Visa validity is over)

    Can any of you gurus give a suggestion as what can be done ?

    Two options come to my mind -

    1. Ask Chennai Consulate if they could extend her Visa citing her pregnancy as reason. But this will Involve again going thru the whole beurocracy again/Police certificate/Medical/
    Fees for both Sister/Husband.
    2. Come to US with her husband.She will get plastic card in 45 days, go back to India, and after her pregnency come back to US in Jan 2004 and start her Job later.

    For now my sister is planning to do the latter. I would appreciate any comments.

    Option 2 would be fraud. The job offer has to be valid for the immigrant visa. She has to report to work for the sponsoring employer when she enters the US with the IV.
    So option 1 is the only option. She also should take the child with her on her first travel to the US with the IV, because the child then automatically gets a GC as well.

      Yes I understand that, it is not the right thing to do.

      But What if she comes to US, she does not join the job immediately but after her delivery in *US*, then joins the job in a few months ? Would that also be counted as fraud ?

        The job has to be immediately available to her and she has to report to work for the employer immediately. Anything else makes the immigrant visa invalid, and using the IV then would be fraud.

          Kid born in India after the interview

          Are you sure that the kid born in India after the interview and not mentioned in any of the papers submitted to th consulate during the interview would be given gc on arrival at US
