  • How long do I have to stay with my current employer after CP

    There is no predefined timeframe.
The issue is that at the time of becoming a PR, you had to have the good faith intent to stay with the sponsoring employer indefinitely. Of course, your intent can change later.
The question really is: how do you prove that you had the good faith intent to stay with the sponsoring employer?
The usual and easiest way is to stay there a significant amount of time. Lawyers usually recommend 6 months as a rule of thumb. But again, this is not cast in stone. It is just a rule of thumb, and it may be different in your individual circumstances.

How long do I have to stay with my current employer after CP

I got my temporary GC last month and am still waiting for the plastic one. But I am thinking going back to school this fall. My question is that can I leave current employer and go back to school as a full time student or how long I have to stay with current employer?

    Any input is highly appreciated

thanks for the timely reply, Joef.

It will be only two months for me to work for my current employer if I decide to go back to school this fall. What will happen if I leave before 6 months? Why should I prove that I had the good faith intent to stay with the sponsoring employer after having my passport stamped? Will it be a problem for me to get the plastic GC?

      Thanks a lot...

The issue is that your willingness to work for the sponsoring employer indefinitely is the basis for your GC.
The deal is quite simple: you agree to work for the sponsoring employer indefinitely, and in return the government gave you a GC. If you don't hold up your end of the bargain, the government can revoke their part.

In general, BCIS doesn't investigate this on their own, but there are a number of situations where this can come up: the employer complains to BCIS; you file another application with them, e.g., naturalization; they look at your file for other reasons,...
As an example of what can happen, non-US citizens have to report address changes. For lots of years, people never bothered. After all, it is such a minor thing. But then came 9/11, and INS got strict. There were a couple of people who got deported because of failing to file address changes.
So it is better to not give them any reason to investigate.
