  • How important are the W2 forms for Consular Processing?

    I have worked only few months last year(2002) so my w2 form shows only few weeks of work. I worked full year in 2000 and 2001. Does this effect my CP? I will be expecting my interview in couple of months. Thanks for any help.

    Well, what did you do when you didn't work? Where you in the US or abroad?
    If you were benched without pay on H1, that's illegal, and would mean that you were out of status. Being out of status for over 1/2 year triggers a 3 year ban.
    They may or may not check the tax returns.

      W2 forms for CP?

      I am in USA for 8 months and then went to india stayed there for 6 months and came back. My application is at NVC right now. Is it advisable to chage it to I485?

        You would face the same kind of questioning with AOS.
        I think that it depends a lot on the reasons for the stay abroad. I stayed abroad before my CP because my H1 ran out, and that wasn't a problem at all.
        If you stayed abroad because the company didn't have any work for you, that could cause problems, because the job offer has to stay valid at all times during the process.
        But in any case, this is something you should discuss with your lawyer.
