  • Official list of documents needed for AC I-140 Application

    A list of AC I-140 application documents exists on this web site under consular processing section. Where can I , however, find the OFFICIAL list of documents required to be filed for an AC I-140 application? Is this official list included in some INS/NVC/Consular office regulations? Is there a web site I can go to and see this official list?

    I surfed INS web site but could not see any official list of documents required for the purpose of filing AC I-140 application.

    Can the administrator tell me where they got their list from?

    You didn't find anything because AC140 doesn't really exist.
    It is an inofficial name of a procedure that is a discretionary practice at some consulates. Not every consulate does it.
    In general, you need attorney-certified copies of the whole I-140 package (that's where the AC140 name comes from). If a consulate receives such a copy of the I-140 package, they may agree to issue an immigrant visa based on the package. But, again, it is discretionary. They don't have to do that.
    So, talk with your lawyer. They know what is required.
    They also know which consulates accept it.

      AC I-140

      I ve been more than 120 days for NVC to create a case for me and still no news. However I decided to apply for AC I-140 route through London Embassy,
      My attorny does not know the meaning of attorney certified? could someone explain this for me please.

        Hmm, an attorney who doesn't know what "attorney-certified" means? Hard to believe. Even I as a layperson without first-hand experience know this.
        Attorney-certificed copy means what it says: the attorney certifies that the copy is an accurate replica of the original document.
        In the AC-140 case, the attorney certifies with stamp and signature on each page of the copy of the I-140 package that the page is an exact copy of the original.

          Thank you for your reply Joe.
          As I said i have been waiting for NVC to create a case for me after i had my I-140 approved last december.
          I have contacted NVC numerous times and they say that they have not received my approval from INS.
          In the meantime I have contacted INS and they say my approval is on transit.
          I have not applied for I-824, do you think this is necessary?
          If i apply for AC I-140, and in the meantime NVC create a case for me what happens then?
          My attorney is not a Immigration attorney , I am the first case she has had dealing with immigration issues
          since she has been appointed by my future employer!!
          I am British Citizen and living in UK.
          Your reply would be much appriciated.

            Unfortunately, it happens that things vanish in transit. This is INS (or now BCIS), after all.I have no idea if an I-824 would help.
            The confusion that is created when NVC creates a case while you are doing AC140 is one reason why several consulates don't do AC140 anymore. If NVC creates a case, it would be important to let them know if the AC140 was accepted by the consulate.
            Finally, it is somewhat unusual for an employer to use a lawyer who doesn't know about immigration for this stuff, but it is of course their decision.
