Candidate 1:

"CSPA Candidate's name was not included in Welcome Letter. NVC was requested to include him and NVC included his name. Fees was paid, DS-260 and documents were submitted. Candidate including entire family awaited for visa interview and meanwhile candidate crossed 21 CSPA age. Finally interview was scheduled and candidate's name was included in IL (I was surprised to see candidate's name in IL).

On Interview day, Visa officer calculated CSPA age and DID NOT ISSUE VISA to CSPA candidate while entire family got visa. Candidate will be the only left out person in India, once family move to US."


Candidate 2:

"On different petition, Candidate's name was not included in Welcome Letter. They contacted some immigration lawyers based in India and Lawyer said no need to worry, beneficiary can request to add candidate's name once interview is scheduled. Once Interview was scheduled, CSPA candidate's name was not there (obviously) and then beneficiary tried to contact US embassy to include candidate's name. I am not sure whether they received any reply from embassy or not.

On the interview day, After entering the embassy, Primary beneficiary requested that they have only one person left out in the petition and embassy asked them to bring in the CSPA candidate (she was waiting outside the embassy, even her name was not in IL. embassy asked family to bring her in) CSPA candidate entered the embassy and candidate was asked to pay IV fees and submit DS-260 forms and come back with documents and forms in 1-2 hours. Embassy also took finger print of CSPA candidate. Finally interview started, Visa officer calculated CSPA age and said candidate is not eligible for visa. Well, I calculated candidate's CSPA age which was just 21 years and 20 days CSPA age. Candidate was just 20 days over 21 CSPA and visa officer DID NOT ISSUE VISA to the candidate. Again, Candidate will be the only left out person in India, once family move to US."

My pd Apil 2004 f4 .My cspa age(21) is over in november 2017 now my current age is 26 now.i have paid my fees and fill 260 in july 2017 and got case complete letter in october 2017. Will i get visa or my age is freeze ?

If the CSPA age is more than 21 you will not get Visa.

How did you get that number?

As per law, they can issue only 4,555 F4 visa per FY per country. However, it can be increased if there is spillover from another F category which has unused Visa numbers (This usually happens towards 4th quarter of FY).

As per my assumption, your might get interview in Mar-Apr or Jul-Aug.

When I see the visa statistics, I count around +/- 10,000 visa F4 for each fiscal year. ( October-September) . Would you be able to explain how you got 4555 for F4? Thanks Popat for all your valuable information.

When you go to visa statistics page, On the right side of page, you will see "Immigrant Visa Statistics" under Visa Statistics. Once you click it, you will see "Annual Numerical Limits for Fiscal Year 2018" under Hot Topics.

Once you hit that link, you would see "foreign state" column. You are right that F4 India gets on approx average of 10k a year, But you should also see that each year overall F india gets approx around 15k. And you can see on that page, what number F foreign states get (its almost same number). It means India F4 gets unused numbers from other India F category each year and that's the reason India F4 gets more numbers (around 10k) than it is allocated by law (4,555 numbers). At the end of the year, India overall gets around 15k which is grated by law, as you can see on that page.

Some year they issue less than 15k and some year more than 15k, its depends on DoS's discretion based on other factors involved.

This is all number game. I hope this helps.

There is no update on Dec numbers yet. I assume it should be out in 15 days.

My presumption is 5000+/- 200 numbers will be used by end of Feb (assumption is based on PD movement Oct till Feb). And Numerical limit for country is 4,555 as per law. However, historical data suggests NVC issued more numbers than numerical limit in past for INDIA (that more numbers depends on many factors which lead to spill over of unused numbers from other categories).

So it will be interesting to see further movement after MARCH or APRIL.

Reiterating this view

I reiterate that Welcome letters are not released at this point for PD beyond 22JUN04 F4 India yet, this could be problematic for F4 India in terms of total spill over F4 India numbers this FY.

Again, We will not see PD movement more than 2-3 weeks/month for remaining FY 2018. 3 weeks would be best movement and 2 weeks to slow it down. Worst case, we could see 1 week movement despite having numbers available (towards the end of FY). This situation could lead PD movement ending between 15APR04 - 15May04 (being bit generous here) at the end of FY 2018.

Well there is still room for more numbers here. I am surprised to see 2 week movement at this point.

I could see the other reason for DoS to slow it down. Lets put it this way, if there will be more delay in sending out welcome letter for people after 22JUN04, PD movement could slowdown remaining FY 2018. If that happens, India F overall numbers would be lesser in FY 2018 than previous years.

We will not see PD movement more than 2-3 weeks/month for remaining FY 2018. 3 weeks would be best movement and 2 weeks to slow it down. Worst case, we could see 1 week movement despite having numbers available (towards the end of FY).

Just clarification, India F4 Numbers available at this point means spillover from other F India category.

No IL Started by NVC for any one Category till Yeasterday.

NVC Replied IL not Scheduled.

So, Might be Monday Onwards they will start Releasing IL for MAY-2018
