  • Some Concerns.

    Hi,

I was going through my Pkt3 mailed by NVC. I had some concerns:

    1. The last name on my and my spouse's passport is different. (I still have my maiden name). Supplement 1 to OF-169 (for India-Pakistan) mentions that "If you are married, your passport should reflect your marriage".
Can this create a problem for us?

    2. In the list where police certificates are NOT available: INDIA is NOT mentioned. Was this the case in earlier Pkt3?

    Please Help!

My wife had kept her maiden name on her passport. She got it changed. I can not recall right now, but i read somewhere that if you keep your maiden name, you will be granted the "greencard" on your maiden name. However I suggest, you change the name on the passport.

If you are an Indian, you do not need to obtain the police certificate from India. Only if you have stayed in any other country [other than USA/India] for more than six months, you have to get the police certificate from that country.

      Hi,

Recently, I got a new passport as the old one is about to expire. My wife's name is mentioned on my passport (with her maiden name. My wife's passport has her Maiden name as her last name). Will this be OK or will it pose any problems during CP interview? Should she get her last name changed on the passport?

Also, do I need to get my H-1 visa transferred from my old passport to the new passport? If yes, where can I find the procedure?

Thanks in advance for any suggestions.

I'm not sure about your 1st question reg. your wife's name.

But regarding your second question, why do you need to transfer your h1 to the new passport? My husband and I just got our new passports and we were not told anything about transfering our visas ... In fact for our H-1 extns. we've given copies of our old and new passport. I believe you just carry both your passports together....

If anyone knows anything about this, pls. let us know...

As per my attorney you do not need a new visa. Just carry both the passports. It should be fine. For my H1B extension I have sent photocopies of both the passports.

I got a confirmation from the mumbai consulate that the policy for obtaining a police certificate has not changed. U do not have to submit any poilce certificate if u have lived only in India and the US.

I am attaching the mail confirmation received from the Mumbai Consulate for ur reference.
