  • Birth Certificate Affidavit Issue

    Hi Administrator,

    My I140 has been approved and I have chosen Chennai as my Consulate. My wife has correct date of birth, in her BC. By mistake, the date of birth in all her records (except for BC) is different. She has got an affidavit from her father signed before a first class magistrate stating the fact. Would that be sufficient, if we go for CP?

    Hi Administrator,

    Is it true that my wife should get a new passport with DOB matching DOB in Birth Certificate? All her school/college certificates match the same as in the passport. The one in the BC is different because by mistake her father gave a wrong DOB at school admission time.

      Read the posting referenced by rs2000. That should answer your question. Of course, your experience may be different at the consulate than the original poster, but then do you want to risk it?

          does birth affadavit can expire?

          i have affadavit of birth made few months ago. i an wondering if needs to made in 6 months of interview?
          does anybody know anything about it?

            I don't think there is any time limit for affidavits. The only time limit I am aware of is the police certificate/employment letter.

              This does happen especially in India, my DOB is wrong too, just by a day, but it will be one hell of an effort to correct it.

                  The indian consulate here in the US can easily correct your birth date on the passport based on the affidavit you may have. All other documents are not so important. Take care of the passport and you should do fine.

                    I did talk to both the SFO and New York Indian Consulates. They can correct only if it is was a Passport office mistake (entering the wrong Date of Birth in the Passport)

                    But if the mistake was done by you while applying for a passport, no affidavit can satisfy their requirement. We have to get a court order from India (nothing less than a I Class Judicial magistrate) to change the DOB on the passport.

                    I also called Chennai Consulate about this problem and if affidavit is enough, they require us to update the passport with the correct DOB.

                      I suggest you make an appointment with the Chief of the visa section @ Indian consulate. Explain him/her your situation pertaining to immigrant visa interview. This might be a long shot but it is worth doing it. It is imperative that passport is corrected.

                      In past, I have spoken with the chief consul [Michigan is under Chicago office jurisdiction] @ the indian consulate in Chicago regarding some other issue [not DOB] and he was very helpful once he learn that my situation was a unique one.
