  • I-130 after 485 denial

I don't know if this is the right place to post this, but my wife and I were denied for our I-485, we're coping with it and we know WHY, we're going to fix that.

The thing is, we still got a letter for an interview for our I-130 in about 2 weeks. Do we still go to this interview? I understand I-130 and I-1485 are for different things.

My wife is going to go back to her home country and we are going to do consular processing, because her mother and grandmother are sick and there is no one else to take care of them, we have no other choice but to do it this way.

I guess my question to sum it all up is: Do we still go to this interview, and can we use it for the consular processing? Or would we have to reapply for EVERYTHING? SHOULD WE reapply for EVERYTHING?

Yes. The I-130 is just about establishing the genuineness of the relationship and doesn't care about where the beneficiary is or what process they will take. The I-130 will continue to be processed and be approved, and then she can do consular processing with this I-130. Make sure they change the I-130 from staying with USCIS for AOS to sending it to NVC for Consular Processing. So you should go to this interview for I-130 if possible.

This is my personal opinion and is not to be construed as legal advice.
