I-140 approval for CP vs. AOS

Hi,

I have read on many postings here that even though the petitioner requested for CP when filing I-140 , the I-140 was approved for AOS / 485 . Does anyone have any idea why this would happen ? Is it due to attorney error while filing the I-140 or does the INS have any other reason to do so. How can this be avoided so that one is sure that when he requests for CP while filing for I-140 , his I-140 gets approved for CP.

I am the case you said

It happens because you are "lucky". It has nothing to do with your attoney or you. You can only pray that you are not the "lucky" one. Other than that, you can do nothing because you are dealing with INS.
