  • Advice to get Canadian Landing Stamp, even I got USA GC.

    Dear Experts,

    I have got USA Green card this month. And I will get my canadian landing paper within 1 month.

    My brother(He is 27) is planning to apply for Canadian PR.
    So, If I have Canadian landing stamp. He can get 5 extra points under adaptability (on brother is in Canada).

    So, I am planning to visit Canada and get 'landing stamp' on my passport.

    I have already I-551 stamp(USA Greencard) on my passport.

    1. When I will enter in Canada, Can my USA GC affect 'Landing Process to Canada' ?

    2. When I will enter in Canada, Can 'landing stamp of Canada' affect my USA GC ?

    3. When I will enter back in USA, Can 'landing stamp of Canada' affect my USA GC ?

    4. What way I should choose to enter in Canada(Air or Road-detroit) ?

    Please guide me, it will help my brother to increase his points and me to maintain my USA GC.

    Points required for Canadian GC is 75 (new rules)

    So if you can avoid doing it, then stay away from it.

    Canadian authorities may ask you of your intention on seeing US GC, they may refuse you Canadian Landed Immigrant status.

        Yes. A US GC Holder must intend to reside permanently in the US.

        If you apply for and obtain Permenant Residence in Canada after becoming a US Permenent Resident the INS can (and probably will) interpret that as meaning that you no longer intend to reside permanently in the US.

        In other words they will assume that you intend to abandon your US residence and revoke your Green Card (since you no longer have the requisite intent of living permanently in the US).

        I could be wrong (and you should check this out with a lawyer before getting Canadian PR) but I think you can't be a PR of both Canada and the US (you have to pick one or the other).
