  • Very Important Question!!!

Has anyone heard about "illigal time" in the U.S.A. This one lawyer told me that if I leave the U.S voluntary that when I get my apoinment in THE US embassy that my visa petition (on behalf of my American husband) will get rejected because I lived in the US illigaly for more than 1 year and that I will be "punished" for being in the US iligelay. Another lawyer (mine) said that this "illigal" time begins after you turn 18???????????????
I would trully appreciate anty helpfull informaiton.
    Thanks....

    ...both are correct.......

you stay "illegally' in the uS if you entered illegally..that is, without a visa
or if you stayed beyond the date authorized on your I-94 or if you worked without authorization. You are barred for 3 yrs if you overstayed more than 180 days but less than ayear and 10 yrs if mor ethan I yr.

The law does say that only illegal stays after age 18 should count against you........

Howeve rif you're married to a US citizen why do you need to leave the US to go to the Embassy? Did you enter illegally?
