  • I-140 Approved for AOS Not for CP

    Folks,

    I've decided earlier to go for CP. At the time of I-140 filing I asked my employer/lawyer to file it for CP. However, I got approved for AOS and not for CP. I want to go through Sydney Consulate. I thought it is better to ask Gurus about the latest information about CP. What do you think still CP is a good option to go or ask my lawyer to file I-824 for AC I-140. Since Sydney I guess still accept AC I-140. A friend of mine advised me to go for that.

    Please advise.

    we too have the same problem. we opted for CP in I140 but it is approved for AOS. we spoke to our lawyer and he said that it was INS' mistake and they would correct it in 2 weeks. It is more than 5 weeks now. Our consulate is Chennai(India), we cant go for AC140.(Chennai consulate doesnt accept AC140).we are totally confused what to do.

    anyone has gone thru the same situation and successfully compelted GC? your help is greatly appreciated.

      Both of you guys are lucky, because you can bypass NVC! File I-824, in 2 weeks you will get RD (receipt notice) from INS. File AC-140 (attorney certified) along with original I-140 direct with your consulate. Since Chennai does not accept AC-140 file with mumbai. By this method you will have saved at least 3 months of routing through NVC, St. Louis, and all that new CP routing that came in from this year.

        Are you going to Sydney or Chennai for Interview ? If you have some information about Sydney Consulate please share with us. How good they are doing AC I-140 ? If anyone knows please share your comments. Thanks

          I just filed my I-140 indicating that I want to do CP. In this case, can I further do AC I-140? Some one told me I can not. Thanks.

            AC140

            You can do AC140 after receipt of original I-140 AD notice. The condition for this is that there should be genuine hardship. I know a case of a guy who is having his interview in Mumbai this month, whose I-140 AD got approved in end of January, but since there was an excessive delay in getting P3 from NVC, his lawyer bypassed NVC and went for AC140. The consulate accepted the case. Generally consulates that do accept AC140 will do so only when there are genuine grounds. Otherwise everyone will start bypassing NVC!
