    Hi!
    I need some advice regarding choosing location for Consular Processing.
    I have just received my labor certification. I am currently working in the US on H1. I also had accepted Canadian Immigration last year - Feb-2001 (Landed Immigrant).
    what should I choose as my place and country for consular processing on my I-140 application.
    I have mentioned New Delhi, India on I-140 to be filed.
    Looking for advise ASAP on what is the right thing to do and what is better - Canada/India

    I have seen success in both and the same amount of time. The only difference is that Canada is closer and probably cheaper than going to India.

      How can you maintain canadian status ?

      Just curious to know, how can you maintain Canadian status and have H1B in USA.
      Don't you have limit of 6 months to stay outside Canada ?

        Question reg Canadian Pernaneant Residency

        I am a Canadian Landed Immigrant working in USA on H1-B since April 1977. I have visited Canada a couple of times till now. I have been filing Income Tax all these years in the same way as all other US workers. I have not followed any special filing procedures as a Canadian Resident. My wife was residing in Canada in my uncle's home in Ottawa till October 1999 and moved to US on H4 in November 1999 to join me.
        I came to know that you are also a Canadian Landed Immigrant residing and working in US on H1-B. I read also that you went to India for US Visa interview. How are you maintaining your Canadian PR?. Are you filing your taxes in any special manner?.
        I have sent Packet 3 to NVC this month for obtaining US Immigration Visa at US Consulate in Chennai, India. Myself and my son have resided for more than six months only in India and US. But my wife resided in Canada for 3 years before moving to US. We all have obtained Police Clearance Certificates (PCC) from Indian Consulate in Washington, D.C. Does my wife need to obtain a PCC for her stay in Canada?. Did you obtain PCC for your stay in Canada?. If your interview is already completed, did the consular officer ask you for Canadian PCC?. If Canadian PCC is required for my wife, what is the procedure to obtain it, how easy is it and how much time is required to obtain it?.
        I would appreciate if you can answer all my questions.

          PCC must be requested from RCMP Ottowa. Finger prints are done in the US and sent to RCMP. Please refer to their web site.

          You will need the PCC to send it along with packet 3, so do it as sonn as possible because it takes up to 2 months to get the PCC.

          The whole process can take 4-6 months but if you have the original documents such as birth certificates, etc it will be without delays because now NVD requires the originals and NVC will review your file and approve it before they can schedule an interview for you in Montreal.

          The interview as I have heard is painless but a bit costly, since you have to travel.

            Rnasrin,

            Shouldnt the FP be done in Canada and then sent to RCMP. If one is outside the US it would be difficult to get it done in US.

              Yes, the FP can be done in a local police station in Canada. RCMP should be able to answer all your questions and forms that you will need to fill out.
