    Hi,
    My wife was resident of Canada for two years before moving to US on H4 visa. Now we have applied for obtaining US immigration visa at US Consulate in Chennai, India. She needs to obtain PCC for her stay in Canada. Can somebody tell me the procedure to obtain PCC for Canada, from here in US?

      Pulitu, Thank you.
      Were you a Canadian Resident before becoming US green card holder?. If yes, and if you worked in US on H1B, how did you maintain your Canadian Green card status?. Why I am asking is, myself, my wife and my son are all Canadian Landed Immigrants and I started working in US on H1B from April 1997. My son is here since then. My wife joined me in 1999. I have been filing my income taxes as any other US worker and not in any special manner. Nowhere I have mentioned I am a Canadian PR. I have INS H1B approvals and extensions till now. We visited Canada thrice till now and came back after two or three days. We have the small H1B and H4 visa stamps in our passports. Will the fact that we are here on H1B for more than 183 days outside of Canada in a year, be a problem in getting US immigration visa during the visa interview at US Consulate in India?. I am concerned that they might ask us how we are considered as Canadian landed Immigrants when we are living in US for more than 183 days. We are in legal status till now as per INS rules i.e., I have a valid H1B approval notice and I-94's. If you know something about this, please let me know.
      Is it better to adjust status here instead of going for Consular processing?

        The Consular Officer won't care about your status in Canada.

          You need to send back a copy of your landing papers with Packet 3 in order to be scheduled for an interview at Montreal. The instructions also state that you need to have resided in Canada for 6 months immiediately prior to coming to the US in order to qualify for a Montreal interview. The INS may ask you about this when they review your papers (landing date compared to I-94 date, e.g.). Another possibility is when you enter Canada next, the Canadian immigration officer may detect that you have, for all purposes, abandoned Canada as your residence and revoke your landing papers/deny you entry - that will be a case of so close, yet so far, then.

          Not an attorney, (nor can I afford one) so don't go suing me....
