  • Complicated Case

    Friends,

My case is a bit complicated.I was working for company A , laid off after I-140 approved. I know work as a consultant for company B.
Company A is willing to hire me back and do my CP so that I will get my GC within 6 months hopefully.
But , the caveat is that my client wants me to join them full-time else I will be let go. I cam join them full-time once i get my GC but I have heard on this forum that you have to stay with your sponsoring employer for atleast 6 months after you get your GC. You are supposed to sign a document saying that when you go for the CP . Is this true ? If so , I guess I can't join my client else my GC will probably be iwthdrawn if I get audited. Please help !!!!

    Thanks.

    Not Legal Advice:

You could do the following: File AOS with employer A. Get EAD. Go to work permanently for Employer B. After 180 days notify INS of change of employer.

As long as the INS takes more than 6 months to process you I-485, and they almost certainly will, you are home free (regardless of when you cahnged jobs). You would only have a problem if they can do the I-485 in less than 180 days (and you are more likely to be hit by lightning).

Also get a lawyer (see if you can talk company B into paying for it) - you will need good legal advice as the AC21 law which allows this to happen is still relatively new.
