  • After I824 approved how long till NVC creates case?

    Gurus, please help.

How long after an I824 is approved does it take the Texas Service Center to cable the NVC?

Is it possible that the cable be sent directly to the Consulate instead of the NVC? -> The TSC automated message indicates the cable was sent to the assigned consulate or port of entry... Is this the "standard" message for all I824 approvals or do they have different messages?

After the cable is sent to the NVC how long does it take the NVC to, acknowledge receipt and create a case number?

    Thanks!

It's been almost 40 days and the NVC has not even received my case, let alone assigned a case number... The TSC is just a dump.

Have you heard anything from NVC?

      Hello yesnow
Have you heard from NVC? I am in the same state you are in currently. 824 approved March 14 at VSC. Are you contacting the NVC directly to find out if a case is created?

Re: Have you heard anything from NVC?

The NVC has sent me formal written notice indicating they have not received anything from the INS Texas Service Center and that further inquiries should be made at the INS.

The INS has admitted they DON'T KNOW if, when and where the cable was sent, if ever, but have not assumed responsibility and have not contacted me to let me know what, if anything they are going to do.

Your I824 was approved only 14 days ago so you should be fine. The average time it takes for NVC to get and input receipt of cases is approximately 15-25 days, so you're still within the norm. Don't panic yet. Also VSC tends to be relatively competent compared with TSC so stay calm. I would call NVC in about one week.

Does your Approval notice indicate that the NVC was "previously" notified of the approval of your case? What does the AVM say at VSC when you call to inquire about your case?

My approval notice indicates that the case was sent to NVC... but I know that is not true.

I would also be very interested to know what did you specify in your I824, did you specify NATIONAL VISA CENTER or did you specify CONSULATE XYZ?

Please let me know, and best of luck. I will let you know the status of my case as soon as the INS responds...

          Thanks yesnow for your reply

About the details you have asked regarding my 824,I don't know yet.The approval notice has been sent to my company by the INS.I would get it from them and let you know ASAP.
          The AVM says that
"The case has been approved on March 14 th and the proper american consulate or Port of Entry has been notified via cable or fax or telephone"

              824 cases

My 824 petition was approved on 03/05/02. NVC AVM still says we cannot find your case information. Anyone has an idea how 824 cases are handled? Do I have to forward my approved petition to NVC or does NSC send it to NVC automatically.
I spoke to the operator at NVC and she told me that it may take upto 90days...
              Any help...

                Re: 824 cases

                roxros,

The INS should sent the underlying I140 petition approval to the NVC. One thing that may occur, due to carelessness on the INS service center is that your consulate (instead of the NVC) could be directly cabled. This is a major problem, since depending on which consulate this is cabled to may or may not decide to receive your case for processing and instead may send the case to the NVC for processing. Problem is the NVC will NOT process the case unless and until it receives a direct cable from the INS.

I know of a few people that have had to refile their I824 petitions and instead of indicating the appropriate consulate they have indicated NATIONAL VISA CENTER. I can't tell you if that works better, but that has never been the appropriate way to fill the form, at least according to my seudo-competent lawyer.

I would really appreciate it if someone else could share their info on this subject.

                  my case just reached NVC

My 824 is approved on 2/7/02. I called NVC number of times.

3 weeks ago I called CSC and they told me that

they sent my papers to storage. They told me that they didn't

transfer the case to NVC. Then I asked my lawyer to call INS and fix the problem. My lawyer called INS and asked them to transfer the file

to NVC. After couple of days I again called INS and explained the case. This happened last week. Finally my case reached NVC on 4/9/02.

Waiting for the case creation and packet 3

I spoke with my lawyer today and she said that they received a letter from NVC seeking to find if I wanted to go for CP.

I do not know if this is a step in the right direction for the case creation but I am atleast happy that some communication has been intiated from NVC.

Did anyone have similar kind of experience?

Re: Waiting for the case creation and packet 3

I've heard that this is becoming more and more common, this means NVC has your case. I think it's just one more step to ensure the process takes as long as possible...

I think you should be fine now. Good luck.
