  • New procedure for CP, from when?

    Hi,

    I(my lawyer) had sent my packet 3( form DS 230 ) to NVC and NVC received my application on Dec 26. NVC has sent a request for all the documents that were sent to them already with my application.

    Does anyone knows what is happening here? When did the new procedure become effective? Does this affect the applications submitted before the effective date?

    Any help is appreicated.

    Even I had the same problem but when my lawyer called back NVC they asked him to send those application and docs to Indian consulate. So we did.

      It is possible that your lawyer sent P3 to NVC instead of consulate, if so, he made a mistake that may cost you a month or two.
      However, it is possible he did do the right thing, you need to provide more info.

        Thanks for you postings.

        I forgot to mention one item. I am doing CP in Montreal. My application was sent before the new procedure was in effect, and the packet had instructions to collect the documents and send only few documents with the application back to NVC.

        Now NVC is asking for original or certified copies of all the documents such as marriage certificate, birth certificates, PCC, even DS 230 -II. I think this is not fair as the instructions were to send only the DS230 part I and cover letter, money and a checklist form( missing anything?).


        I am asking my attorney to call and check with NVC as application was sent as mentioned in the packet.

          As you may know, Canada consulate used this new procedure long before other consulates.

            I'm going to Montreal, and exactly the same thing happened to me. They asked for originals or certified copies and DS230-II where they didn't ask for in the beginning. It's a shame, because now we'll have more delays.

            Do you know how long the delay will be if we resend them what they want. Will it take another month before they review it again?

              Could be more than a month

              My guess, delay could be more than a month. especially in my case. My attorney has been very slow preparing and sending documents to INS/NVC. Once I give all the documents to my attorney, it will take more than a week for them to send it to NVC. NVC took 23/24 days to take up my case which is not bad. but it took 16 days to get the letter to my attorney. So in my case expected delay is about two months.

                One more point

                I have checked the packet that was sent by NVC that to my attorney. The cover letter says the this packet includes OF-169 that says

                Second: Obtain teh following documents on this checklist which pertain to you. As you obtain each document, check the box before each item. Do NOT send them to NVC or the consular office.


                Now NVC is saying that OF-169 is not mean for the CP in Canada. A rep in NVC is saying that my lawyer had sent me wrong fom. And above all, it seems that there is no way that NVC will admit this and let me application go ahead without the copies of the documents.

                I am so frustrated by all this.

                  I am in the same boat. The instructions that came with my Pkt 3 requested the originals or certified copies. However, my lawyer refused to send the originals and he certified the copies as "Attorney Certified". They did not accept them. Moreover they wanted a Police Certificate from France where I lived for 10 months long time ago. The rule is 12 months but we didn't want to argue too much. The PC from France was pretty easy in one week I had it already. Now we sent everything on 2/7/02 and waiting.
                  Some lawyers don't know that the instructions in the Pkt 3 for Canadians is different and they don't pay attention and trash them thinking that they get the same instructions in every Pkt 3. The same thing happened with me initially my lawyer sent me some instructions but then I told him I want the exact instructions that came specifically in my envelope.

                    certified docs

                    I have the same problem with my birth certificate. I sent them certified translation and a copy of the original. Then they said I need to send either the original or a certified copy.

                    One thing that they said doesn't make sense to me. They said the issuer of the b-cert should certify it. That doesn't make sense because the issuer does not certify the certs they issue. I also don't want to send the original because it may get lost in the mail.

                    Why don't they accept an attorney certified copy?

                      Documents

                      I got mine translated from the embassy in Washington, DC. I mailed them the original with a copy of the birth certificate. They stamped the copy with the seal of the embassy saying "True Copy" and attached to it the translation and both stamped together.
                      Initially I sent them a copy of the translation. Now I sent them the original translation with the embassy stamped copy of the BC.
                      If this doesn't work I have to send them the original. When did you mail yours. They received my fedex on 2/7/02 but did not show in their system as received till 2/12/02.
