Help .. need advice !!

I-140 AD 2/6/02 from TSC. I had indicated CP from Delhi so to make sure I called the IIO today and was told that the 140 was not approved for CP !!!

What can I do now?? I really want to do CP? I waited 11 months for my approval and now TSC screws me .....

TSC did not screw ur case but your lawyer. Anyway..now u gotta apply for I 824 for changing from AOS to CP. Here is more detail :

you have to file form I-824(Print 2 sided on short edge) with INS which sends the information about your I-140 approval to National Visa Center in Portsmouth, New Hampshire. That office then makes an electronic copy of the petition and forwards it to the consular post. NVC will also create a case number and send Packet 3 (described below) to the candidate. Filing of I-824 can delay the processing considerably.

as I have the copies of the filed I140 .... the lawyer has correctly marked for Consular Processing and also written with a Marker in CAPITALS ... "Consular Processing through New Delhi, India" on the first page ....

He also mentioned the same in the covering letter ....

I am EB3(RIR) ...will Delhi accept my AC140 ??

AC140 is good idea.....Delhi will allow your AC140....
