Lost Passport with H1 Visa/I 94

I lost my passport which was having a valid H1 visa and valid I-94. I applied for a new passport and got one. I already applied for a replacement of I-94. I am planning to go to India for my green card (Consular Processing) in next 1-2 months and so my attorney advised me that I do not need to stamp current H1 on my new passport as I will be returning on a new 'Immigrant' type of visa.
Did anyone of ever face such situation or can advise me on this issue: whether I need to stamp H1 on my new passport or not? I should but if I send my passport for stamping I may stuck up for 6-8 weeks and may miss my interview date.

Your attorney is right. Just take a photocopy of the new I94 with you to show that you were in status.
