    Do the depends need to have a H-4 approval notice from INS ? In my case, the company did not file for H-4 separately..When we entered the US, all of us entered on the I-797 (original H-1 approval notice) and I-94 has a note of validity date and the company name..Is this enough ? Abu, what do you think.?

    Not Legal Advice:

    A Visa says you can travel to US. I-94 says you can enter and stay for certain period of time.

    Photocopies of all I-94s should be enough. You need to prove you were in the country legally with permission from INS and that you remained in status. Visa (H4 or otherwise) does not indicate this. I-94 does so it should be enough.

        Nothing to be overly concerned about. Right now, yours and your family members I-94 should be valid. That is very important. They don't need seperate INS approvals unless you change your job or file for your extension, only then you must file for your family members' status extension. This you must remember to do. Even if your attorney or anybody else says it is ok NOT to file for their extensions that just yours is enough, dont' believe them. It is INS law that once inside USA, when the primary applicant files for extension, all dependants must file for extensions also.
