  • Merger/Acquisitions-I-140 Amendments

    Hi!

    Recently, my company got merged with our parent company. this happened after I had sent the PAcket-3 to Chennai. I am expecting my interview date. Can anyone let me know what to do now.
    The options I could gather from the immihelp.com site are

    1) File for a new I-140 with my the new company(ex-parent) now.
    2) File for an I-140 amendment indicating the merger/acquisition.
    3) Go to Chennai and attend the interview, but carry the merger documents.

    What is the best legal procedure of the three above.
    Is anyone in the same situation. or has been in the situation?

    I would appreciate your help.

    Not legal advise: (2) in my opinion since it takes less time.

      Hi

      I am in the same boat.It is best to have an amended I-140 from the new company.
      But if you can get a employment letter on the old letter head and not talk about merger you may get it.Not legal advise.Technically it is not correct.
      Best option to get a new I-140.

        1) How long did it take to get the New I-140 for you?
        2) Do you know, how long an amendment to I-140 will take?

        Since my interview is not yet scheduled, probably, if my new company applies for the new/amendment, I may still be able to attend the interview.

        What are you planning? Are you attending the interview with the old packet-3 info. or Are you filing a new Packet-3? What is the right procedure, Did you check with the Chennai Consulate?

        Also, if we carry the employment letter head on my old compnay name, the pay stubs would have changed reflecting the new company name. That would be a problem right?

        Could you let me know? Thankx

          If merger becomes legaly effective on a later date, you should take advantage by using old I140 and old company name, letter head.
