    If Job title used for H1B is not exactly same as Labor cert/I140 then what do I write on Form DS-230 , Item #12 as "Present Occupation" ?.

    On H1B it is "Software Engineer".
    On Labor cert/I140 it is "Programmer Analyst".

    As per Lawyer (?) , I should write ""Programmer Analyst" on DS-230.

    Going for CP, will it be an issue because it does not match with what I had on H1B petition ?

    Please help.

    OK - One more time:

    The LC is for a job in the future. In other words the LC is for the job you are going to take up upon arrival as a permenant resident. The Labor Cert has absolutely nothing to do with your current employment. In fact your current employment is irrelevent to the Process - unless you lie about it and they find out.

    If you are presently working as a software engineer then put that down as your present employment. Since the LC is for a completely different job (it could even be with a completely different employer - it would not matter to them) it should not have any bearing on the process at all (other than to demonstrate that you are employable and thus less likely to become a public charge).
