    Probably this question has been discussed hundred times - but here is a story -
    my current title is different from one in LC, salary is less then in LC as well, and my interview in January next year. Good thing - job description asbolutely the same with one in LC.

    My lawer (who, by the way, should take blame for this mess) keep saying that I should not go for CP, and only option - AOS. But if salary mismatch is an issue for CP - it would be the same for AOS. etc.
    Has anybody had the same issues? Any recommendation? My employer would not change my salary / title overnight.

    Many with same issue.

    If your employment letter will say (future) permanent position will be with title and salary as stated in LC,I140 you are good to go.

    It could be explicit, that is, explicitly specifying future title and salary, or it could be implicit, by saying that your sponsor's continued intentions as set forth in approved Labor Certificate and I140 are reaffirmed herein.

    Now, differences in titles are more subtle. What you may consider different is similar under DOL/INS regulations and I saw many posts that say so from experience.

    Also consider full compensation, including everything. Take a look at your recent paystub to see what your YTD full compensation is inc. bonuses and what IRS considers as compensation, even if some of it you never really had, e.g. paper gains on ESPP/stock options, moving expenses etc.
    That number might be >= LC and that's still compensation.

      Thanks, Abu - good idea - I mean full compensation. With bonuses and stock grant it would exseed salary in LC.
      But not sure that term "salary" is equal to "full compensation". Probably, it would be up to consular officer.

      Regarding title - I called independent lawer, not company - provided, and he said that job description is a key. Title itself is secondary.

      When you mentioned another posts - are they on the same board? Where can I find it? Would be really helpful to look through other people experience.

        Not legal advise:
        You don't need to include job desc. in the letter (though it is perfectly fine if you do AND it is same as LC).

        Implying job desc and salary is excellent way to avoid problems with you sponsor.

        Employment letter can specify the annual compensation with dollar amount $.
