  • Switch from CP to AOS (I-485)

According to the FAQ posted on the website of The Law Office of SM the process of switching from CP to AOS after the approval of the I-140, is relat. easy. Quote: " If your I-140 indicates that it was approved for CP you can go ahead and instead file for I-485 without any extra request or extra steps. You simply file your I-485 application."

How can I get a copy of approved I-140 to enclose it with the I-485 app.[it must be the actual approved I-140 not just I-797, right?]? Is the approved I-140 sent to the NVC? Does the petitioner (employer) get a copy from INS?
    Thanks!

I797 is approval notice. I don't think there is anything else.
To do AOS you file I485.

      I-797 suffices for I-485 app.?

So, to the contrary of the I-485 section of the immihelp.com, a copy of the approved I-140 does not have to be enclosed with the I-485 app.? Just the I-797?

Re: I-797 suffices for I-485 app.?

What I understand is that there is the I140 filing you and your lawyer do. Then, it gathers dust at INS and then you get approval notice.

          Switch

You include a copy (not the original) of I-797 Approval Notice of I-140 petition with I-485 filing.
