I 140 never reached NVC

My I 140 approved on July14th hasn't yet reached
the NVC. As advised by some members on this forum
(and NVC operators) , i tried to contact
CSC but I can never get through their phone.

On eliciting help from my lawyer, he is advising
me to instead apply thru EAD/485 process, saying
that it will be tough tracking my case and that
EAD/485 process is 'less risky' and only
2-3 months longer than going through CP. True ??


Does anybody know what are the steps to switch
from CP to EAD ? or any idea if switching to
EAD is a good step. I see people trying to switch
from EAD/485 to CP and not vice versa. I have
this nagging suspicion that my lawyer is acting
at behest of my employer and stalling the process
to go for the longer option.

Any help/pointers are much appreciated.

I too am in the same situation. I called NVC, they say they have not rcvd the I-140 and asked me to call VSC. spoke to IIO at VSC and she told me that they have sent it to NVC and it might take some time to get on their system. My lawyer says to wait.

Meanwhile you could file EAD/I-485 with your approved I-140.

SImilar situation. I140 approved on Aug 3, 00. Never got to NVC. I have been pushing my lawyer to sort it out. She claims to have had severla converstaions with Officer at the INS. Finally, the officer found otu that the file was sent to AOS processing. The bofficer said it will get fixed in about 4 weeks.

That's where I am.....

My suggestion to you, let your lawyer do the talking. Keep pushing for it....it's your lawyer's job!

No. They still don't see me on the system. I just called them a few minutes ago.
I don' know what is going on?
Excuse my language but I am just getting really fed up with the system and my lawyer's inability to get me back on track.

Does anybody know if I can just sort this out or at least verify what my lawyer is saying, through another lawyer?

I have been waiting since July myself.

Hi folks,

From what I learn from your discussion you can file 485 even if 140 is approved for CP. Correct ??

I suppose this is attempted in the cases when there is a problem receving PIII.

My question is this: Lets say you start 485 and later on you suddenly receive PIII what do you do....
I see 3 options:
1. Continue doing 485 and dont send your packet III
2. Discontinue 485 and send packet III
3. Continue 485 and send packet III

Any comments from anyone, especially from immihelp, is greatly appreciated.

hey guys.. my I-140 was approved on 3rd of july from CSC and never reached NVC. After 90 days we got NVC to fax us a letter requesting a duplicate from CSC. then we pressurized our attorney till he finally sent a fax to CSC. After that, on October 16th we suddenly got a second I-140 approved from CSC. And now finally on November 17th that I-140 has been received by NVC.

I've noticed that fax f/u either by the attorney or the employer is very effective. Also, if you can enclose a letter from NVC stating that after 90 days they still haven't recd. the file, that helps too.
