  • Consular processing question

    I was in US for 6 years (H1-B Limit). My employer has applied for my GC. My I-140
    got clear after I left USA. When our lawyer applied for I-140 he opted for consular processing
    as he was sure that it will not come through before I leave. Now it is cleared and my case
    has been sent to Bombay consulate by NVC (National Visa Center).

    1) Will it cause any problem as I am not employed with my current employer ?

    2) I overstayed in US for about two months (Waiting for I-140 to clear) but during that time H1
    extension was applied for and by the time I left it wasn't through. Will it cause any problem during
    CP interview at Bombay consulate ?

    3) Do you have any useful tips / information on this based on your experience ?.

    No problems

    You shouldn't have any problems as far as I know.

    Legally you can stay 180 days and if it was 2 months which is 60 days then that is ok.

    The GC is for your future employment and not for your current. So you should be fine.

    Anyway take an attorney advice before going ahead.
