CP done and got I485 approved.

Guys,

Just wanted to find out something I cannot call it fortunate or unfortunate that happened in my case.
I got my CP done in Mumbai on the 20th of October and landed back on the 29th.

Yesterday I found out that I also got my I485 approved by the INS.

I had filed it at CSC on the 17th of July.

Category EB2
PD February 1999.

This is life!!!!!!!!!!!!!

1. Had you been fingerprinte
d before you went for CP ?

2. Had you filed the I824
? I don't recall if yours
was a CP through NVC or if
it was the old ACI140.

Yes FP before I went for CP and mine was Attorney cetified.

But I did not file I824.

Why are you asking me this?

Sorry I did not mention about how I handled this situation.

I informed my attorney as soon as I landed back and I am assuming that they informed the INS inturn (not sure though). After two weeks of me landing I got a call from my attorney saying that my I485 got approved.

Still trying to find out if my attorney cancelled my I485 or not.
It is implied that they had not because if that was the case then my I485 should not have come through (assuming INS works that efficiently).

Will let you know how things work out.

Hi r****csc,

The reasons I asked you the questions are
(and thanks for your earlier responses
with promptness) :

1. It is always possible that somebody else is
not as fotunate as you. Even after CP being
successful one might return to find I485 being
rejected or an RFE awaited or a call for interview.
In that case the situation might get quite messy
at least for a while. Needless to say that
something like this happening might delay plans
to change employer etc. It is good that in your
case the outcome is a happy one.

2. Being fingerprinted before going for CP always
makes it a possibility of both CP and AOS results
coming through (and so I asked you that question).
If the FP was done long back then it is a little
unfortunate if the AOS outcome is not known and
one has to go through the CP stage -- even though
the vacation can be an enjoyable one.

3. About I824 I posed the question because the intent
of I824 is to prevent something like this (what
happened in your case) happening. i.e best case,
before CP (or AOS decision is taken) INS would
either continue or discard your AOS application.
But the problem is unless they get to the I824
in time the 'simulataneous' action on your CP and
AOS can still take place.
What is troubling me is that I824 does not prevent
the bother one has to go through in case of this
sort of thing happening. One would still have to
talk to lawyers and INS and make sure this double
decision somehow does not work against you. As
somebody said there is no logic in their actions
and so two-approvals does not mean you are all
clear. Anyway, I would take 2-approvals than any
other mix/match !
