If I-140 is approved for AOS, and I decide to do AC140 at Mumbai consulate (AOS application NOT filed), do I need to file I-824 with INS?

Is this true even if I-485 is never filed?

I gather from the recent memo that I-824 is needed only if you already have a I-485 pending and want to change route to AC140.

As per the new rules, you'll need the I-824 receipt even if you haven't applied for AOS.

I-824 requirement

If you wish to file AC I-140 and will not send the I-824 receipt to the
consulate, your application will be denied. You can email Mumbai
consulate's Immigrant Visa Unit department and they will tell
you the same thing.
