  • Successful CP in Montreal but with hiccups

    Hi guys and gals,

First of all I want to thank all the participants in this dicussion board who provided me with so much valuable information and support.I completed my consular processing successfully in Montreal yesterday. Most of the stuff was just as has been reported earlier except for the fact that I had the misfortune of being interviewed by a jerk (who called himself a Consular Officer).

Anyway here is how the story begins. My interview was on Nov 7 and I reached there exactly at 8:30. Went through the Security and waited for my number to be called. Around 9:30, I was called to a window for document verification. She checked all my documents and the contents and asked me to pay S$260 per applicant. The details in which she went made me wonder if she was doing the interview. Anyway, was told to wait for my name to be called for interview.

About an hour later, was called to be interview by this jerk. He is a oldish looking guy with a beard. He started off by having us swear the contents of the forms. Then he started off asking all sorts of questions. He was rude to the point of telling my wife to shutup while he was talking to me. He checked my visa expired on 12/15/99 while Canadian Landing Paper had entry date of entry as 2/14/00. Had to show him the H1 extention till 1/25/00 (fortunately I carried all H1s) and rest of the time was for moving.

Thats when he hit on (his) jackpot. He asked me how come my petition was initiated by one company and completed by another. Told him that the previous company was merged by the other company. This is big merger we are talking off. He wanted proof of the merger. Showed him an ammendment of I140 that was filed. He told me that either I could wait till the ammendment was approved or get an document. The statement in the Employment Letter was not sufficient. On asking him specifically which document he wanted, he threw his head in his hands and said the interview was over. He did not issue the visa and gave me a letter asking me to get proof of merger.

I had to go back to the hotel, get some document faxed by the company. Fortunately, Montreal consulate accepts walk-ins on Wednesday (next day). Went back to have the same guys look at the documents. Fortunately he accepted the 'Certificate of Incorporation' as the proof. He gave me a @#%$-n-bull story of how many frauds he sees and is very thorough in his job. Well, Mr Thorough completely missed to detect that my wife's name had been mis-spelled in PC from India. Neither was I in the mood to point it out to him.

I still need to enter in US. Hopefully that will be a smooth one. But who knows.......

    Thanks.

          Re: Pdixit a few questions

I did my Medical in Edmonton (Alberta) which took about a week. The PC was also obtained from Edmonton. I believe there was a lady also who is more courteous and non-confronting who was doing interviews. My Packet 3 was delivered by mail to NVC.

            Immihelp,

My experience is something that you should mention on your site. This Consular Officer was very picky and rude and hell bent on harassing us. Also, if there is a merger, no matter big or small, people should carry all possible proofs, like Ammendment to 'Certificate of Incorporation', Press Releases, etc. Be prepared to be grilled and asked stupid, embarassing questions (like were you on H1 before getting married).

Also, like Mumbai consulate, there is a Photo shop in the basement of Montreal Consulate where you can get the photos for $4.25 in 4 minutes.

            Thanks.

Thank you for sharing your experience. I have been assigned my date in December so hopefully I have a better experience than you.

MSMIZ, Montreal is different than India, in our case, everything goes throught the NVC until the actual interview so there is no question of hand delivering. All documents have to be either mailed or courrier to the NVC in New Hampshire. The Montreal Consulate will not get your file until your date has been assigned.

                Congratulations...

I have few questions , could you please answer?

                1) What is 'Certificate of Incorporation'?

                2) Is you I-140 filed before the merger or after the merger?

In my case, I got labor from company A, after that my company merged with company B. After the merger I filed I-140 from company B with company A's labor.

Is this a problem? Do I need to get "Certificate Of Incorporation" ?

                Thanks in advance,
                -SKorandla

                  Hello pdixit
Can you answer the following qns.

                  1.
Do you have to obtain an RCMP police certificate for the CP. If so did you get one through finger
printing or one by walking to an RCMP office without any finger prints.

                  2.
My particular line of business is being spun off into a different company. My H1s and I-140 are all
obtained using the parent company's name. Do you know whether I need to carry some other docs.

                  Thanks for the help.

                    skorandla,

                    Answers to your questions:

                    1. Certificate of Incorporation is filed with a state by a company when it starts a business. It contains, amongst other information, the name of the business, address and type of business. What I had was an ammendment to the Certificate stating that the name of the company has been changed to the other company ( because of the buyout).

                    2. My I140 was filed a few days before the merger. But it does not matter. He was looking at the fact that the GC petition was initiated by one company and completed by another. So, to be on the safe side, get as much documentation, specifically anything filed and/or approved by State or Federal Govt.

If I were you, I would be prepared to be grilled by this guy. I have heard of other people also having a hard time with this guy. There is a lady also and she is much better.

                    nnmsriram:

                    Answers to your questions:

                    1. I had both. Initially, not knowing that the residents of Canada need only name based PC from Canada, I had obtained a fingerprint based PC from Ottawa. However, if you are a resident of Canada, you need only a name based PC from local RCMP office.

                    2. I would strongly recommend that you obtain documents. He cannot refuse you the visa, just harass you. So, why take the risk when you have time.

                    Best of Luck.
