  • AOS approved but AC140 intrv in Nov....

    Hi,

    My I-485 got approved, it was a shock! I got
    the notice in the mail today. I have an AC140
    interview with Mumbai in Nov.
    I had applied for AC140 on Aug 10th and was
    accepted with a case number on Aug 29th.
    It was not required to file for I824 then.
    Mumbai has not even asked me for it.

    Now the questions are:

    1. Can I use the I-485 approval and get the
    passport stamped and abandon the AC140?

    2. If yes how do I do that? I do not want to
    get into trouble?

    Please advice. Immihelp/others please advice what
    my options are?

    I think you should talk to your attorney about this...Probably you can call the consulate and tell them that as your AOS is approved, you would like to cancel your CP application. Having got AOS approval on hand, you are done with the GC process, go and get the stamping.

      unfortunately...

      I do not have that much time. I will
      be leaving for India on Tuesday night.
      That gives me two days to get the stamp.

      Immihelp, can you shed some light on this?

      I have talked to some people and they say
      to cancel the AC140 interview after getting the
      stamp. Since no I824 was filed the AOS was
      not abondoned.

        Just go and get your passport stamped. Cancel your interview for CP.

          It would be interesting to know whether you had
          fingerprints done recently. If so then I wonder if
          that would have been a more appropriate time to
          cancel the CP interview. If you had fingerprints done
          several (6-12 months) back then I can understand why
          you would have waited until now.

          Immihelp,
          Can you suggest what would be better ? If one has the
          fingerprints done here as part of the 485 process will
          it be a problem if one goes ahead with CP and returns
          to have the FP done again at the port of entry ?
          Also what if you return to find the 485 approved ?
          Would it mean there might be two alien numbers assigned
          for you ?
