As yours is an AC140 case, you have to be an AOS applicable, which I presume you are. If you have filed an I824 then I don't think you can jump the gun to the AC140 route.

I responded to someon's question where he was confused as to if he required an I824 even though he already had an interview date from Mumbai on his AC140.

Apparently it seems like he deleted his posting or don't know what happened as his question is missing.
