    Hi

    My lawyer had file my I140 in EB3 but my I140 has been approved in EB2.I do have a bachelors with 5+ years experience. My papers would be sent to NVC for CP soon. For EB2 by priority date is current. Do you think there will be any problems in the future. I was about to quit the company in the persception that mine would be in EB3 and i would need to wait for a while for my PD to be current. If its going to be in EB2 i would like to stay on.

    BS + 5 seems like EB2

    Well if BS+5 years it does sound like EB2. Hey take the opportunity and run with it. I don't think anyone but the INS case about validating an EB2/EB3.

    The NVC just forwards your documents and the Consulate verifies the vaildity and authenticity of your documentation. The Consulate never gets into questioning if you should be E2/E3. So make full use of the windfall.
