    Hi,

According to the Department of State memo, you can apply for consular processing at any accepting consular post provided you have your I 485 filed. But after filing I 824 does I 485 get abandoned? is there a way to revive the I 485 process? Does this memo make it clear that your I 485 is not abandoned? In short are your I 485 and CP running in parallel?? and until the time comes when you are scheduled for an interview with the consulate, can u revive your I 485?
PLease try and clear this for me anyone

    thanks

    Re:department of State memo

    Hi,

According to my lawyer, there are three options in the I824 :

    1) to apply for a duplicate approval notice
    2) Request your case to transfer to the consulate for doing CP.
    3) Request that the US consulate be notified after your
    I-485 was approved.

When file for I824 only request for option3, since only
recipt notice is required and all notice will be the same no matter which options you choose. So there will be no impact to your I485 application.

But i am still having lots of doubt of whether this is
ok or not, because you are trying to outsmart the consulate somehow. Since the original idea of filing for I824 is to have your case transfer to do CP.

Any comment on this? Does anyone knows whether all the consulate require I824? Does the Hong Kong consulate require also?

    Please help.
