  • choice of consulate

    Hi,

Can you choose which consulate you want your
    CP application sent to?

Or do you have to go to the consulate which covers
your jurisdiction? In this case, how is this determined?
Where your permanent address is or where you stayed the
    longest?

Is there any risk in opting to go to the consulate of your
choice instead of the one that covers your jurisdiction.

    Thanks.

I think (from what I have read on this site and from what my lawyer told me)..

You have to go to the consulate which covers jurisdiction of the city/region of your home country.

"Home country" I believe is the country of your present citizenship or the country which you are a resident. As an example if you are a German citizen having a Canadian permanant resident status, I believe
you can choose the appropriate US consulate in Canada (just for convenience) rather than having to go to Germany for doing your CP.

Again ask your lawyer before taking any decisions.

NVC will assign your consulate for you base on the last residence rule. You do can request the case to be sent to the country where you had your citizenship. Call NVC, they will tell you the official word. They will ask you to fax a letter to them stating your ground for nominating the consulate. They will reassign it if they consider your hold the ground.

Don't rely on NVC to decide your consulate. While applying I-140 your lawyer will ask you for the consulate. Choose one based on your state. You can check Delhi or Bombay USA consulate web site to see the which state cases are handled by whichc consulate
