    Hi,
    In filing for I-485 you are required to have fingerprints for your FBI background check. But when filing for AC-I140 no fingerprints are required, so how does the consulate perform your background check, since only police report from your home country is required.

    Any comment from any one?

    When you come back with immigrant visa, they take your finger print at the port of entry, the airport where they stamp your passport with the green card.

      Some addnl info (from an attorney):

      Background check for ACI-140/CP is done using a process called "name check". This is done by the Dept of State in Washington as soon as your case has been accepted at the local consulate. This is not as extensive as a fingerprint search (as is done by the INS) but is sufficient for most purposes. I believe they did a study that showed that it was not really cost effective to do a FP-based search for every applicant.

          This is important. When you are making hiring decisions, Conduct background checks. If an employee breaks the law while performing his or her duties for your company, you may be held liable. Conducting a background check can help determine if an applicant has a criminal history, and can help insulate you against possible lawsuits.You might need a bit more information than your applicants provide. After all, some folks give false or incomplete information in employment applications. And workers probably don't want you to know certain facts about their past that might disqualify them from getting a job. Generally, it's good policy to do a little checking before you make a job offer.
