Yet another CP in CJ Question

The memorandum mentions that you need to have a
pending 485 w/ the Service center. Do I have to be the
primary applicant?

My spouse has applied for I485 and I am a dependant on
his application. I now have an approved I140, applied
for I824 (not received the receipt yet - i.e NVC
hasn't started processing it). Immihelp, do you
think I qualify? My lawyer says no, since the pending
I485 is not in my name.
