    Mogambo:

    I have same problem as you had. My wife's birth certificate doesn't
    have her mother's name.Now I know that I should get affidavit from
    her parents. But such affif\davit should be from first class magistatre.
    But they say that first class magistatre does not have powers to
    sign such affadavit .

    So what did you do ?

    Affidevt From Executive Magistrate is also Accepted, Normaly these kind of Affidevts are NOT signed by First Class Magistrate in India. IF you have some problem of Date of Birth Change in Passport THEN ONLY First class Magistrate has to sign the Affidevt which will be Accepted by passport office. For CP or AOS the affidevt Signed by EXE Magistrate have been Accepted in PAST.

      You might be right but here is the reply from mumbai.
      So its quite confusing. Did you take this kind of affidavit for CP ?

        Mango I have Read the Email from Mumbai Consulate, Please also Check the Mumbai Consulate website go to this site and Click on Left side of wesite where you see INDIA it will take you to diffren Indian consulate and Click Mumbai Consulate then Click for IMMIGRANT VISA in Mubai consulate site and look for the ANS if you do not have BC or Affidevt. There is no requirement that Affidevt should be signed by First class Magistrate.
        For your Information My friend who done CP Mumbai in FEb 2000 had only affidevt Signed by EXE Magistrate and it was accepted.
        If you find time write again to Mumbai Consulate that, will they accept Affidevt Signed by Exe Magistrate as it has been accepeted in the Past and First class Magistrate does not Sign the Affidevt for Birth Cerificates in India.

          THIS THE INFORMATION FROM MUMBAI CONSULATE, THEY have NOT Demanded that Birth CERIFICATE Affidevt should be Signed by FIRST CLASS MAGISTRATE:

          In cases where birth or marriage certificates from the authorities are unavailable or contain insufficient information, a sworn statement executed by either the parents of the applicant, if living, or other close relatives older than the applicant, all of whom must have personal knowledge of the birth or marriage, may be submitted. The affidavit should set forth the relationship between the deponent and the applicant, how well the deponent knows the applicant, how the deponent comes to know about the facts to which he or she is swearing, date and place of applicant's birth or marriage, and any other related facts. Such an affidavit, when a birth or marriage certificate is unavailable, must be accompanied by a document from a competent governmental authority confirming that the birth or marriage certificate does not exist or no longer exists.

            1. It is not as complicated as it looks.

            2. What I had done was get two notarized affidavits: one from my wife's mother and onother one from her maternal uncle older than her mother.

            3. Mumbai consulate did not even ask for it.

            My personal opinion is that the birth certificate becomes an issue if it doesn't have the applicant's name or an incorrect name or incorrect birthdate ( not consistent with passport).

            I think if you do this,it should suffice. Hope it helps.
