  • CP with J1 HRR waiver? Please HELP.

    Hello Gurus

    Please help on this one, I came to US on a J1 exchange visitor program with a 2 year Home Country residency requirement. My company wanted me to stay back and work for them, so I got a waiver and H1, and now I have sent my Packet III to New Delhi.

    I got my Packet IV and realized it says a reason for exclusion is not completing your 2 year home residency requirement. Though it also says that immigration officer can waive this by looking at the waiver etc. Now my question is that I am not a doctor just a computer professional, so how would the officer find my reasons for waiver good, etc.

    Please suggest.

    All you need to do is carry the original of the 2 year home residency requirement waiver from INS that is all the officer is intrested in, if INS has waived your 2 years and given you an H1, it doesnot matter whether you are a doc or an engineering. The counsellar officer has no discreetion in this manner, during my CP interveiw(I am a Doc), the American officer was very unhappy that no body comes back for 2 years and INS gives everyone a waiver, he commented that he woudlnot waive anybody, but couldnot do anything anyway, I got my IV. So donot worry if your paperwork is in order everything is fine.

      Thanks! I was out of town so could not thank you before. One more question, What do I mark in Packet IV where it asks for HRR completed?

      Any precautions you would recommend.

        Just marked completed and write INS waiver. No other precautions and all the best.

          Last one, the question is are you ineligible to receive IV because.... An alien who is subjected to 212(e) I guess with the waiver I am not subjected to HRR so maybe the anwser is NO.
