  • Petition is current ?

    Hi Guys,

    I called up NVC yesterday and it says my petition is current and further communication will be sent to my attorney. What does that mean ?

    I appreciate your replies.

    Petition is current!

    It means, that shortly they are going to creat an immigrant visa no. for you and will send OF-230I and other forms to your attorney. If you are from India then your PD is not current according to recent visa bulletin. Before sending these form to your home consulate please make sure that your PD is current, because sometime they don't accept the forms. Anyway this is good news for you. Good luck.

      Well, you can send in your forms if your PD is going to be current within 60 days. Since EB3 dates are now at Feb 98, I'd say you can send in your case to consulate within next month or two !
      My PD (EB3 India) is Feb 99 and I plan on filing AC-140 at Mumbai within next month.

      Second the opinion that Mumbai will NOT warehouse cases where PD is not current. So, make sure that the timing is right !!

        What do you mean by make sure the timing is right.

        "We do not warehouse app" is there on Chennais new website also.

        My PD is 09/99,Case is current @ NVC and will probably need to wait for 2 more months.

        Iam Expecting EB3 PD movement dates something like this

        April 15 bulletin - 07/98
        May 15th bulletin - 01/99 ( no more EB2 allocations ?)
        June 15th bulletin - 07/99 or 08/99 or 09/99

        Any Ideas ????????

          Confusion ! Did you not say in your original post that your PD is 12 Apr 99 ?? In this last post you say it is Sep 99 !

          If you send in your forms without the PD being current OR 60 days from being current, your home consulate can (and maybe will) reject the papers and send them back. They will NOT keep the forms with them and start processing when you date becomes current in the future. This is what they mean by "not warehousing cases". So, adjust your "timing" to make sure that the papers reach at such a time that the consulate will process them and not reject them because of your PD.
