Rejected CP can come back on H4 if Spouce has H1?

Hi,

If Husband and wife both has H1, only husband applies for CP and if that gets rejected can he come back to US on H4 as his wife has valid H1 visa ? also what if cp is thru' CJ, Maxico ? can any one came back to US if CP is rejected from Maxico ?

What if both are rejected. Hey be optmistic, I am yet to see any rejections ( Last 4 years).

So best of luck just go ahead and do it, CP is the way to go.

Hi ! I heard that during CP, they cancel all your non-immigrant Visas. And moreover, CP cases are non-discretionary .. Cannot be refused unless there is evidence of fraud etc. If you are missing documents, you will be given a chance to produce them.

Most of the time they cancel you H1 "Without Prejudice". However when I went thru the CP interview at Chennai, I don't know if they forgot but they did not cancel any of our H1s that day though everyone got our packages to carry to the POE.
