    Since you are doing CP in Mumbai, can you tell me what your Pkt3 says about BC's for persons born in India before 1969.
    The requirement for BC registration only came in force in 1969 and the INS knows about it as per the FAM documents.
    If its not too much trouble please let me know.

    Not at all. It is my pleasure. What you should do is just apply with your local authority of Registrar of deaths and births to get the BC. If at all you have not registered, you can re-register and get it. Sometimes they deny to issue but you can get it by backdoor pilicy. I guess you could get me.

      What I really wanted to know was the exact wordings of the packet 3 from Mumbai about Birth Certificates and does it mention anything about persons born before 1969.

        Well the P3/P4 does not mention any such thing about 1969 etc,etc. Its just the year when the law of birth's and deaths was enacted in India from when it became mandatory to record all births and deaths in India with the registrar of birth's and deaths.

        So what this means is if you were born after 1970 and did not record you birth & if the records in that office remained in-tact (not destroyed flood/fire etc,etc). It will be extreemly difficult to get you birth added to the records ( takes 6 months plus - long judicial process).

          Does this in any way make it easier for people born before 1969.
          There was no requirement and the INS knows that so what does the non avaialbility cert prove ?.
          Is it absolutely required in these cases or affadavit from parents stating birth was never registered sufficient.
          Even the FAM for India is not clear.

            Yes- What this means is that if you were born before 1969 & claim you birth has not be recorded it is easier. If its after 1969 then in some places you have so explaining to do as to why your birth was not recorded ( as it was Law to record it) - But not really a big deal.

            Why the consulate needs this--
            1. Notaries are Dime a Dozen so its easy to get as many Affadavits with "Whatever you need" in these Affadavits.
            2. What is the proof that your are not falsifying you birth record that exists ?

            It basically proves from 2 sources that what you claim is accurate/Correct.

            This is absolutely required so don't even try to show up for the interview with just Affadavits (You will be asked to come back). Also recently a friend of mine who file I485 with just Affadavits was sent an RFE for non availability from the birth certificate.

            Also note the Affadavits are stating you birth facts, NOT STATING THAT YOUR BIRTH WAS NOT REGISTERED as you have stated.

            Still want to try your luck, maybe you can post your experience after your CP interview.

              Well XKRUGER you asked me to post my experience after my CP interview regarding BC affadavits.
              Ihad the interview last week and gave only affadavits and they did not ask a single question about it and I got my visa, so all is well that ends well.

                JKSingh: I am still hanging around here to get my Pkt III from NVC. Anyway Congrats!!! At last you are out of this GC ordeal. Cool man. Take the best benefit of this GC in this slow economy period.

                Anyway can you post your detailed expereince emphasizing more on BC affidavits I mean to say running commentry at interview and consulate

                  Thanx for the post, In my case the Consulate office did scan thru my file and read my Non availability letter from the local municipality on my birth details.

                  I knew this vey well because I had added photocopies for all originals that I wanted back. So I noticed that they office pause a bit on that doc before giving me the original ( Its really arbitary). My point was its better to be safe than sorry
